征地主要指国家出于公共利益的需要,按照法定程序强制征用农民集体所有土地,并根据补偿标准一次性给予被征地者(包括土地所有权人、使用权人以及土地承包经营权的发包人、承包人、转包人等)一定的货币补偿,有的还必须按照要求进行必要的就业安置。

报批流程详解
  一、征地申请:项目业主根据国家和自治区征地报批的有关规定,向市国土资源局提出建设项目征地申请。
  征地申请须提交的材料包括:项目征地申请报告、建设项目用地预审批复文件、项目审批文件(项目核准或项目备案材料)、项目用地规划范围图相关资料等。属单独选址建设的项目,需提交地质灾害和压矿评估报告备案文件;项目涉及占用占用林地的,需提交林地批准文件;项目涉及土地复垦的,需提交土地复垦方案审查意见。
  二、政策审查。市国土资源局对项目业主提交的征地申请材料进行审查,符合征地条件的,将征地任务分解、下达给辖区人民政府、市征地拆迁办及相关部门,并由项目业主委托测绘技术单位(市国土资源信息中心)开展土地勘测定界工作。
  三、勘测定界。辖区人民政府组织被征地群众配合市国土资源局、市征地拆迁办、测绘技术单位实地踏勘征地范围和权属界线,测绘地形、地物和地貌,核定土地地类等工作;
  四、发布征地预公告。市征地拆迁办根据土地勘测定界初步结果,拟订《征收土地预公告(送审稿)》,经市国土资源局审核后,报市人民政府发布《征收土地预公告》。市国土资源局将《征收土地预公告》转市征地拆迁办交由辖区人民政府在被征收土地所在的镇(街道)、村(社区)进行张贴、公告,同时抄送市劳动和社会保障局、市农业局、市公安局、市民政府局等相关单位;
  五征地调查。市国土资源局组织辖区人民政府、市征地拆迁办及相关部门对征地涉及的土地权属、地类、面积进行调查,调处土地、房屋权属纠纷,核定被征地农村集体经济组织人均耕地面积和征地前后人均耕地变化情况,地上建(构)筑物和附着物的种类、数量、结构、产权等情况。辖区政府及其征地拆迁办组织被征地农村集体经济组织、土地承包经营户及相关权利人在《征地情况调查表》、《征收土地面积确认表》及《征地地上附着物补偿登记表》等征地报批材料上签字、确认并报送市征地拆迁办;
  六、社会保障情况调查。辖区人民政府在市征地拆迁办、市劳动保障局、市民政局及市卫生局的指导下,调查征地涉及土地承包经营户人口、户数及其就业、社会保障情况,编制被征地农民花名册,核定符合社会保障条件的人口、户数,计算被征地农民社会保障费用及政府、个人的分担份额,拟订《被征地农民社会保障实施方案(征求意见稿)》,按规定公示后,报送市征地拆迁办审核、市劳动保障局审定;
  七、社会保障方案审查。市劳动保障局对辖区人民政府、市征地拆迁办报送的《被征地农民社会保障实施方案》及相关资料进行审查,出具《被征地农民社会保障方案审查意见》并抄送市征地拆迁办、市国土资源局;如属报国务院审批征地的建设项目,上报自治区劳动和社会保障厅出具《被征地农民社会保障方案审查意见》,并送市征地拆迁办、市国土资源局;
  八、组织征地听证。市征地拆迁办对辖区人民政府及相关部门报送的征地材料进行审查,拟订《征地听证告知书》,报市国土资源局审定后,由辖区人民政府将《征地听证告知书》送达被征地农村集体经济组织、土地承包经营者及相关权利人;对申请听证的,由市国土资源局依法组织召开征地听证会;
  九、征地报批。市征地拆迁办根据征地报批材料齐备情况,按照有关规定拟订征地报批“一书四方案”,收集和组织征地报批相关资料并协调市财政局或项目业主单位落实征地报批费用后,将征地报批材料送市国土资源局审核后报市人民政府、自治区人民政府(或国务院)审批;
  十、缴纳报批费用。市财政局根据自治区国土资源厅缴费通知单、市国土资源局缴费函及征地报批费用上缴财政单据,办理征地报批费用上缴和入库工作,由市国土资源局协调自治区国土资源厅办理建设用地审批手续。

  当征地的对象属于基本农田、基本农田以外的耕地超过35公顷的、或者其它土地超过70公顷三种情况的,必须由国务院批准。不属于这三类土地的,则由省、自治区、直辖市人民政府批准,并报国务院备案。
  征地的程序分前后衔接的两大块,即征地的批准程序和征地的实施程序。在征地过程中,征地的对象必须符合城市规划的规定。所有土地必须得到相关部门的批准方能征用。
(一)征地的批准程序
  征地的批准程序:
  1、建设项目依法经国务院或省政府批准。
  2、建设单位向市、县政府地政部门提出建设用地申请。
  3、市、县政府地政部门审查后拟订征用土地等方案。
  4、经市、县政府同意后逐级上报。
  5、征用土地等方案依法由国务院或者省政府批准。
(二)征地的实施程序
  征地的实施程序 :
  1、发布征地公告
  (1)发布机关:市县政府。
  (2)发布范围:被征用土地所在地的乡(镇)、村。
  (3)公告内容:批准征地机关、批准文号、征用土地用途、范围、面积以及征地补偿标准、农业人员安置办法、办理征地补偿的期限等。

  2、办理征地补偿登记
  (1)登记机关:征地公告指定的政府地政部门。

  (3)登记期限:征地公告规定的期限。
  (4)登记所需材料:土地权属证书证书、地上附着物产权证明等文件。
  (5)不办理登记的后果:不列入补偿范围。
  3、拟订征地补偿安置方案
  (1)拟订机关:市、县政府地政部门会同有关单位。
  (2)拟订根据:土地登记资料、现场勘测结结果、经核对的征地补偿登记情况、法律法规规定的征地补偿标准。
  (3)方案内容:土地补偿费、安置补助费、青苗补偿费、附着物补偿费等事项。
  (4)方案公告:市、县政府地政部门在被征用土地所在地的乡(镇)、村公告方案,听取被征用土地的农村集体经济组织和农民的意见。
  (5)报批:由市、县政府地政部门报市、县政府批准。
  4、确定征地补偿安置方案 确定和批准机关:市、县政府(并报省政府地政部门备案)。
  5、实施征地补偿安置方案
  (1)组织实施机关:县级以上政府地政部门。
  (2)费用支付:在方案之日起3个月内侠客支付给被征地的单位和个人,未按规定支付费用的,被征地的单位和个人有权拒交土地。
  6、土地交付 被征地单位和个人应当按规定的期限交付土地。
(三)征地补偿费用项目
  1、土地补偿费 用地单位依法对被征地的农村集体经济组织因其土地被征用造成经济损失而支付的一种经济补偿。
  2、青苗补偿费 用地单位对被征用土地上的青苗因征地受到毁损,向种植该青苗的单位和个人支付的一种补偿费用。
  3、附着物补偿费 用地单位对被征用土地上的附着物,如房屋、其它设施,因征地被毁损而向该所在人支付的一种补偿费用。
  4、安置补助费、 用地单位对被征地单位安置因征地所造成的富余劳动力而支付的补偿费用。
(四)征地补偿标准数额
  1、各项征地补偿费用的具体标准、金额由市、县政府依法批准的征地补偿安置方案规定。 2、土地被征用前3年平均年产值的确定(有关土地补偿费、安置补助费的补偿标准):按当地统计部门审定的最基层单位统计年报和经物价部门认可的单价为准。 3、按规定支付的土地补偿费、安置补助费尚不能使需要安置的农民保持原有生活水平的,可增加安置补助费。但土地补偿费和安置补助费的总和不得超过土地被征用前三年平均年产值的30倍。
(五)补偿费用的管理和归属
  各项补偿费用由被征地单位收取后,按如下方式处理:
  1、土地补偿费、依法应支付给集体的安置补助费、集体所在的青苗补偿费和附着物补偿费,由被征地单位管理和使用。
  2、青苗补偿费和附着物补偿费归青苗和附着物的所有者所有。
  3、安置补助费的归属、使用:
  (1)由农村集体经济组织安置的,支付给农村集体经济组织,由其管理和使用。
  (2)由其他单位安置的,支付给安置单位。 (3)不需要统一安置的,发放给安置人员个人或经被安置人员同意后用于支付被安置人员的保险费用。
  集体所有的补偿费用的使用收益分配办法:
  1、在当地金融机构设立专户存放。
  2、使用情况公开,接受村民监督。
  3、分配办法经村民会议或村民代表会议过半数通过,报乡政府备案。
(六)征地补偿纠纷及解决方式
  1、补偿标准争议 先由县级以上政府协调,协调不成的,由批准征用土地的人民政府裁决。
  2、补偿费用分配纠纷 其性质为民事纠纷,当事人为村委会或农村集体经济和村民,当事人可以通过民事诉讼解决。
  3、征地信息公开纠纷 属于行政争议,当事人可以通过行政复议和行政诉讼的方式解决。

拆迁房屋补偿
  目前我国的拆迁集体土地住宅房屋的拆迁补偿方式分为货币补偿、产权调换和农民自建3种方式。
  一、实行货币补偿的,货币补偿金额包括被拆迁集体土地住宅房屋补偿价和宅基地土地所有权区位补偿价。计算公式分别为:
  (1)被拆迁集体土地住宅房屋补偿价=被拆迁集体土地住宅房屋补偿单价×被拆迁居住房屋建筑面积。
  被拆迁人在同一拆迁范围内有多处集体土地住宅房屋的,应区分房屋结构、等级分别计算合并补偿。
  (2)宅基地所有权区位补偿价=宅基地综合补偿单价×核定的宅基地土地补偿面积。
  附:未超过批准使用期限的临时建设房屋,按照重置成新价和剩余使用期限予以补偿,不给予宅基地土地所有权区位补偿价。集体土地住宅房屋补偿单价、宅基地土地所有权区位补偿单价由市国土房管局根据从化市国民经济发展水平、从化市国有土地所有权基准地价、房地产市场变化情况予以适当调整,经市人民政府批准后定期公布。
  二、实行产权调换的,被拆迁人的安置面积按照以下标准核定:被拆除房屋的批准建筑面积低于(25-30)平方米/人的,按人均(25-30)平方米核定;在(25~60)平方米/人之间的,按批准的建筑面积核定;超过60平方米/人的,按人均60平方米核定。2人以下(含2人)的户,按2人核定;已婚并达到法定育龄夫妇尚未生育子女的按3人核定。被拆迁人在同一拆迁范围内有多处集体土地住宅房屋的,应合并计算房屋建筑面积。
  附:以下情形,被拆迁集体土地住宅房屋按房屋补偿价给予补偿,不再提供安置房或者另行安排宅基地:
  (一)被拆迁人除被拆除的集体土地住宅房屋外,尚有其他集体土地住宅房屋,且其他集体土地住宅房屋达到人均建筑面积40平方米的。
  (二)拆迁非本村籍的外来人员的居住房屋。
  三、实行农民自建,应符合土地利用总体规划、城市规划和村镇规划,并按相关规定进行建设。
  (一)本村集体经济组织尚有宅基地,可以安排宅基地给被拆迁人自建住宅或由村集体经济组织统一建设住宅。
  1.如由被拆迁人自建,拆迁人对被拆迁人按照被拆迁集体土地住宅房屋补偿价给予补偿,对集体经济组织按照宅基地土地所有权区位补偿价给予补偿。
  2.如由村集体经济组织统一建设住宅,拆迁人按本规定第九条的有关规定给予村集体经济组织补偿,由村集体经济组织将建成的安置房分配给被拆迁人。
  (二)本村集体经济组织尚有农用地,可转为非农建设用地供村集体经济组织统一建设安置住宅的,由拆迁人依法办理集体土地征收、农用地转建设用地等手续和支付相关费用,对村集体经济组织按照被拆迁集体土地住宅房屋补偿价给予补偿。
过渡期内的临时安置补助费
  一、搬迁补助费(含电话、有线电视、空调、水表、电表、家电家私等搬迁涉及的一切搬迁费用)
  拆迁人对在规定时间内签订拆迁补偿安置协议并完成搬迁的被拆迁人,本村户籍人口每户可享受搬迁补助费;
  非本村户籍人口,但有祖屋在拆迁区域的被拆迁人每户可享受拆迁补助费;超过规定期限仍拒不搬迁的,拆
  迁人将申请依法强制拆迁,并不给予搬迁补助费和奖励。
  二、临时安置补助费
  (1)(被征用地块需安置人数×补偿倍数)>15时
  总安置费=该被征地块前三年平均年产值×15

地上附属物的拆迁和青苗补助费补偿
  土地拆迁补偿=土地种类×亩产量×该类土地补偿标准
  土地种类:土地种类、稻田、专业菜地、鱼塘、旱地、果园、茶园、水塘、渠、坝等
  青苗补助费=果树种类补偿×青苗生产期标准×果园面积
  果树种类:油茶、油桐、苗木、花卉、药、材桃、李、梅、橙、板栗、奈李、柚、葡萄、核桃等其他果树
  林木种类:杉树、国外松、樟、梓、楠、稠、马尾松、泡桐、其他乔木、其他树木及竹类
  青苗生产期标准:果树类按栽种年限划分;林木类按树苗高度和胸径来划分。
  附:水池、粪池、井、排水沟、晒坪、挡土墙护坡、围墙、水渠、坟地等按省、自治区、直辖市规定,一般按市场价格进行补偿。种类划分与各类补偿标准由省、自治区、直辖市物价局定价。
中国土地管理法对农田征收的规定
  中华人民共和国土地管理法 第四十五条 征收下列土地的,由国务院批准:
(一)基本农田;
(二)基本农田以外的耕地超过三十五公顷的;
(三)其他土地超过七十公顷的。 征收前款规定以外的土地的,由省、自治区、直辖市人民政府批准,并报国务院备案。
第四十六条 国家征收土地的,依照法定程序批准后,由县级以上地方人民政府予以公告并组织实施。 被征收土地的所有权人、使用权人应当在公告规定期限内,持土地权属证书到当地人民政府土地行政主管部门办理征地补偿登记。
第四十七条 征收土地的,按照被征收土地的原用途给予补偿。 征收耕地的补偿费用包括土地补偿费、安置补助费以及地上附着物和青苗的补偿费。征收耕地的土地补偿费,为该耕地被征收前三年平均年产值的六至十倍。征收耕地的安置补助费,按照需要安置的农业人口数计算。需要安置的农业人口数,按照被征收的耕地数量除以征地前被征收单位平均每人占有耕地的数量计算。每一个需要安置的农业人口的安置补助费标准,为该耕地被征收前三年平均年产值的四至六倍。但是,每公顷被征收耕地的安置补助费,最高不得超过被征收前三年平均年产值的十五倍。 征收其他土地的土地补偿费和安置补助费标准,由省、自治区、直辖市参照征收耕地的土地补偿费和安置补助费的标准规定。 被征收土地上的附着物和青苗的补偿标准,由省、自治区、直辖市规定。 征收城市郊区的菜地,用地单位应当按照国家有关规定缴纳新菜地开发建设基金。 依照本条第二款的规定支付土地补偿费和安置补助费,尚不能使需要安置的农民保持原有生活水平的,经省、自治区、直辖市人民政府批准,可以增加安置补助费。但是,土地补偿费和安置补助费的总和不得超过土地被征收前三年平均年产值的三十倍。 国务院根据社会、经济发展水平,在特殊情况下,可以提高征收耕地的土地补偿费和安置补助费的标准。
第四十八条 征地补偿安置方案确定后,有关地方人民政府应当公告,并听取被征地的农村集体经济组织和农民的意见。 第四十九条 被征地的农村集体经济组织应当将征收土地的补偿费用的收支状况向本集体经济组织的成员公布,接受监督。禁止侵占、挪用被征收土地单位的征地补偿费用和其他有关费用。
